POLICY PURPOSE

Pursuant to 34 CFR 668.43(a)(5)(v) and 34 CFR 668.43(c) the University must disclose to prospective and enrolled residence instruction and distance education students whether the education programs leading to professional licensure or certification meet the educational requirements in the state in which the student is located. NC SARA requires the University to disclose to only prospective and enrolled distance education students the same information. In order to keep with the intent and spirit of the Federal Regulations the definition of student location is different from the definition used for NC SARA.  This Policy will address those requirements.

POLICY APPLIES TO

Prospective and enrolled students, both distance education and resident instruction.

DEFINITIONS

Location– Student location is the state where the enrolled student indicates is their permanent home address as entered into the Banner Student Information System (Banner). 

For purposes of NC SARA, a distance education student’s location shall be defined as the place in which a student is currently living (e.g. physically living at the time and not related to a permanent address) at the time of enrollment before making a financial commitment and while enrolled in a professional or occupational licensure or certification program, not the student’s state of residency.

Permanent address – where a student did reside and where the student actually could still reside in the future. (for example a student’s parent’s address).  It is not a temporary location on campus or a temporary address that a student resides at while attending school.  Permanent address is identified as “mailing address” in Banner. 

Prospective Student-Prospective student means an individual who has viewed the University website or has contacted the University requesting information concerning admission.

Enrolled Student-for the purposes of this policy enrollment has occurred when a student admitted to the University and/or a professional or occupational licensure or certification program has registered for courses.

NC SARA-National Council for State Authorization Reciprocity Agreement 

Distance Education-Education that uses one or more technologies to deliver instruction to students who are separated from the instructor and to support regular and substantive interaction between the students and the instructor synchronously or asynchronously. Technologies used for instruction may include the following: Internet; one-way and two-way transmissions through open broadcasts, closed circuit, cable, microwave, broadband lines, fiber optics, satellite or wireless communication devices; audio conferencing; and video cassette, DVDs, and CD-ROMs, if the cassette, DVDs, and CD-ROMs are used in a course in conjunction with the technologies listed above.?

Resident Instruction-Education requiring students to attend class sections in-person at a physical location, either on a campus operated wholly or in part by the university or other appropriate locations under the supervision of instructional staff representing the college. This includes, but is not limited to, courses instructed on the Pueblo Campus, the Colorado Springs Campus, Fort Carson, the STURM Collaboration Campus, and local hospitals

POLICY STATEMENT

The University provides education to students who intend to reside in Colorado and those who intend to reside in other states.  In doing so, the University seeks to provide the most accurate information regarding the requirements for professional licensure or certification in other states so that students can make the most informed decision about their educational goals and career successes. To this end, the University discloses to prospective and enrolled distance education and resident instruction students the educational requirements of the programs that lead to professional licensure or certification in the state in which the student is located.  This is done by a general disclosure located on the University website.  Once a student enrolls in a program leading to professional licensure or certification, the University will provide a written disclosure of the requirements for professional licensure or certification in the state the student is located. The University, pursuant to 34 CFR 668.43(a)(5)(v) also does a direct written disclosure to a student if the student informs the University that they have relocated to another state, other than Colorado, within 14 days of the student providing this information.

            A Prospective student’s location is their state of residence at the time they apply for admission. If a student does not have a permanent address within the United       

            States or a territory of the United States, their location for the purposes of this policy will be considered the state of Colorado; ?please note that the Office of Admissions will determine the prospective student's state of residence for tuition classification separately. The student location may change if the prospective student contacts the Office of Admissions (prior to registration) or the student (following registration) provides formal notification to the University via the online  student information system (Banner) to change the Mailing address or by submitting the “Change of Permanent Mailing Address” form located in the Registrar’s Office of a change in state location. This policy does not supersede tuition residency requirements pursuant to Colorado law.

            Enrolled Students may report a change in location (mailing address) by using the online student information system (Banner) or by submitting the address change form located in the Registrar’s Office of a change in state location.
